Code violation 05-06-2011

I recently received a code violation regarding an installation of a heat pump at a second house I rent to a client.
I obtained a licensed contractor to obtain and install the unit. However, the contractor did not obtain the necessary permit to do the installation.
The inefficient Code Enforcement Department cited me for the so-called infraction. As far as I know, the licensed contractor, licensed and insured, has the reponsbility to file for the necessary permits to do the contracted job. If that is so, why am I being penalized for an inappropriate installation, when all I did was to obtain an individual to do the work and my responsibility was to pay for the service provided.
Perhaps a court could straighten this entanglement.
